Payment Methods - Wildgraphy

1. Introduction and Scope

This Payment Methods Policy ("Policy") is issued by Wildgraphy Adventures Private Limited ("Company," "Wildgraphy," "we," "us," or "our") and governs the payment methods accepted, payment processing, currency handling, and related terms applicable to orders placed through www.wildgraphy.com and www.wildgraphy.in (the "Platform").

This Policy shall be read together with the Company's Terms of Use, Order Cancellation & Return Policy, Return & Exchange Policy, Open Box Delivery Policy, and Shipping Guide, each available on the Platform.

This Policy is framed with reference to the Payment and Settlement Systems Act, 2007, applicable directions and master circulars issued by the Reserve Bank of India ("RBI") governing payment aggregators, payment gateways, and card-on-file tokenization, the Information Technology Act, 2000 and rules made thereunder (including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011), the Prevention of Money Laundering Act, 2002, applicable Foreign Exchange Management Act, 1999 ("FEMA") regulations governing export transactions and receipt of foreign exchange, and the Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020. No provision of this Policy shall be construed to exclude, limit, or waive any statutory right available to a Consumer under applicable law that cannot lawfully be excluded or limited by agreement.


2. Rationale for This Policy, Including the Exclusion of Cash-on-Delivery

2.1 Nature of the Products

Given that the Company's catalogue consists substantially of high-value, fragile, and, in a material number of cases, one-of-a-kind original artwork, the Company has determined that Cash-on-Delivery ("COD") is not offered as a payment method for any order placed through the Platform, irrespective of order value, product category, or delivery destination.

2.2 Basis for This Restriction

This restriction is adopted for reasons including, but not limited to:

(a) Non-recoverable production cost. A material proportion of the Company's products, in particular Customized Products and Original/One-of-a-Kind Editions, are manufactured or reserved specifically upon order confirmation. Where a COD order is subsequently refused at the point of delivery, the Company would bear the full, non-recoverable cost of production, materials, and outbound logistics, with no reasonable prospect of recovering that value through resale, given the bespoke or singular nature of such products.

(b) Fraud and non-collection risk. COD transactions carry a materially higher rate of refusal, non-collection, and fraudulent order placement across the e-commerce sector generally, a risk that is disproportionately acute for high-unit-value, fragile goods of the kind sold by the Company.

(c) Reconciliation and audit requirements. As the Company deals in goods of significant individual value, prepayment through traceable, auditable electronic payment channels supports accurate financial reporting, GST compliance, and reconciliation, consistent with the Company's obligations under applicable tax and corporate law.

This exclusion applies uniformly to all Customers and all orders, and no exception shall be made on a case-by-case basis, including for repeat or high-value Customers, save where the Company expressly agrees to an alternative payment arrangement in writing for a specific institutional or trade transaction outside the ordinary course of Platform checkout.


3. Definitions

  • "Payment Aggregator" or "Payment Gateway" means a third-party entity authorized by the RBI to facilitate electronic collection of payment from a Customer on the Company's behalf.
  • "Order Confirmation" means the point at which the Company confirms acceptance of a Customer's order, following successful payment authorization.
  • "Prepayment" means payment received and successfully processed in full prior to Order Confirmation, this being the sole basis on which orders are accepted under this Policy.
  • "Chargeback" means a reversal of a card transaction initiated by a Customer's card issuer following a dispute raised by the Customer.
  • "Sensitive Payment Data" means card numbers, card verification values (CVV), UPI PINs, net banking credentials, or other authentication data used to effect a payment.

4. Accepted Payment Methods

4.1 Available Methods

Subject to Clause 2, the Company accepts payment through the following methods, as made available via its engaged Payment Aggregator:

(a) Credit cards (Visa, Mastercard, American Express, RuPay, Diners Club, or such other network as may be supported from time to time);
(b) Debit cards issued by banks operating in India or, for international Customers, internationally recognized card networks;
(c) Unified Payments Interface ("UPI");
(d) Net banking, for banks supported by the Company's Payment Aggregator;
(e) PayPal, for international Customers where offered; and
(f) such other electronic payment method as the Company may enable from time to time, as displayed at checkout.

4.2 Mandatory Prepayment

All orders placed through the Platform require full Prepayment prior to Order Confirmation. No order shall be processed, and no product shall enter production or be reserved for a Customer, until Prepayment has been successfully received and verified by the Company's Payment Aggregator. No partial payment, deposit-and-balance arrangement, or deferred payment shall be accepted through the Platform's standard checkout flow, save as may be expressly agreed in writing under Clause 2.2.

4.3 Method Availability by Order Type

The Company reserves the right to restrict the payment methods available for specific product categories (including high-value Original/One-of-a-Kind Editions) to methods offering additional transaction verification or reduced Chargeback risk, as determined by the Company at its discretion, and as displayed at checkout for the relevant order.


5. Payment Processing and Security

5.1 Role of the Payment Aggregator

All payment transactions are processed through the Company's engaged Payment Aggregator(s), operating in accordance with applicable RBI authorization and directions. The Company does not directly collect, store, or process Sensitive Payment Data on its own systems; such data is collected and processed solely by the Payment Aggregator's PCI-DSS compliant infrastructure, in accordance with the Payment Aggregator's own privacy and security policies.

5.2 Tokenization

Where the Customer elects to save card details for future transactions, such details are stored solely in tokenized form by the Payment Aggregator or card network, in accordance with applicable RBI card-on-file tokenization directions, and are not stored by the Company in raw, unencrypted form under any circumstance.

5.3 Transaction Authentication

All card transactions are subject to two-factor authentication in accordance with RBI directions, including One-Time Password ("OTP") verification or such other authentication mechanism as may be mandated from time to time. The Company shall not process, and has no mechanism to process, any card transaction that bypasses mandated authentication requirements.

5.4 No Liability for Payment Aggregator System Failure

The Company shall not be liable for a failed, delayed, or duplicated transaction arising from a technical failure, outage, or error on the part of the Payment Aggregator, the Customer's card issuer, or the Customer's bank, provided that the Company shall provide reasonable assistance to the Customer in resolving such failure with the relevant third party, and shall promptly refund any amount confirmed as erroneously charged, in accordance with Clause 8.


6. Currency and Pricing

6.1 Base Currency

All transactions are ultimately settled in Indian Rupees ("INR"), being the functional currency of the Company. Where the Platform displays pricing in a currency other than INR for the Customer's convenience, such display is indicative only, calculated using a reference exchange rate that may not precisely match the exchange rate applied by the Customer's card issuer or Payment Aggregator at the time of actual transaction settlement.

6.2 Currency Conversion

Where an international Customer's payment method settles in a currency other than INR, currency conversion is performed by the Customer's card network, card issuer, or the Payment Aggregator, and the exchange rate and any conversion fee applied is determined solely by that third party, in accordance with its own terms, and is outside the Company's control. The Company shall not be liable for any variance between the indicative price displayed on the Platform and the final amount charged to the Customer after currency conversion by a third party.

6.3 Price and Tax Inclusions

Displayed prices shall indicate whether applicable taxes (including Goods and Services Tax, where applicable to the transaction) are included or additional, in accordance with applicable Indian tax law. For international orders, displayed prices do not include customs duties, import taxes, or similar charges levied by the destination country, as further described in the Company's Shipping Guide.


7. Cross-Border Payment Compliance

7.1 FEMA and Export Proceeds

Where an order is placed by a Customer located outside India, receipt of payment shall be treated as receipt of export proceeds in accordance with FEMA and applicable RBI directions, and shall be processed using a purpose code and documentation appropriate to export of goods, as required under applicable regulation.

7.2 No Facilitation of Circumvention

The Company shall not accept, structure, or facilitate any payment arrangement intended to circumvent applicable foreign exchange control, customs valuation, or tax reporting requirements, whether at the Customer's request or otherwise. Any Customer request inconsistent with this Clause 7.2 may result in the Company declining to process or cancelling the relevant order, without liability to the Company.


8. Refunds

8.1 Refund Method

All refunds due to a Customer under the Company's Order Cancellation & Return Policy, Return & Exchange Policy, or Open Box Delivery Policy shall be credited solely to the original payment instrument or method used at checkout. No refund shall be issued in cash, to a bank account, UPI ID, or card different from that used for the original transaction, save where the original payment method is demonstrably no longer valid or accessible (for example, an expired card), in which case the Company shall coordinate an alternative refund mechanism directly with the Customer, subject to reasonable verification of the Customer's identity and entitlement to the refund.

8.2 Refund Timeline

Refund processing timelines are as set out in the Company's Order Cancellation & Return Policy, Return & Exchange Policy, and Open Box Delivery Policy, as applicable to the circumstance giving rise to the refund. The Customer acknowledges that the timeline for funds to reflect in the Customer's account following initiation by the Company is thereafter subject to the processing timelines of the Customer's bank, card issuer, or Payment Aggregator, over which the Company exercises no control.


9. Chargebacks and Payment Disputes

9.1 Preference for Direct Resolution

A Customer with a concern regarding a transaction, product, or order is strongly encouraged to contact the Company directly at support@wildgraphy.com in the first instance, in order to allow the Company the opportunity to resolve the matter under its Order Cancellation & Return Policy or Return & Exchange Policy, prior to initiating a Chargeback with the Customer's card issuer.

9.2 Response to Chargebacks

Where a Chargeback is initiated, the Company reserves the right to contest the Chargeback before the relevant card network or issuing bank by submitting evidence including, but not limited to, order records, delivery confirmation, Open Box Delivery inspection records (where applicable), and prior correspondence with the Customer.

9.3 Chargebacks Found to Be Unsubstantiated

Where a Chargeback is reversed in the Company's favor following dispute resolution by the card network or issuing bank (that is, the Company is found not liable for the disputed amount), the Company reserves the right to restrict the Customer's ability to place future orders on the Platform using the payment method associated with the disputed Chargeback, and, where the Chargeback is determined by the card network to have been fraudulently or falsely initiated, to pursue such other remedies as may be available in law.

9.4 No Exclusion of Genuine Dispute Rights

Nothing in this Clause 9 shall be construed to discourage or penalize a Customer from exercising a legitimate Chargeback right in respect of an unauthorized transaction or a genuine, unresolved grievance; this Clause is directed solely at Chargebacks subsequently determined to be unsubstantiated or fraudulent.


10. Fraud Prevention

10.1 Verification

The Company and its Payment Aggregator reserve the right to conduct reasonable verification of a transaction prior to Order Confirmation, including but not limited to confirming billing address consistency, device and transaction pattern review, and additional authentication, where a transaction is flagged as carrying elevated fraud risk.

10.2 Right to Decline or Cancel

The Company reserves the right to decline, delay, or cancel an order where a transaction is suspected, on reasonable grounds, to be fraudulent, unauthorized, or in violation of this Policy or the Company's Terms of Use, and shall, where an order is cancelled on this basis after Prepayment has been received, refund the Prepaid amount in full within the timeline set out in the Order Cancellation & Return Policy, save where the transaction is confirmed, following investigation, to be fraudulent, in which case the Company shall cooperate with the relevant card network, bank, or law enforcement authority as required by applicable law.


11. Data Protection

11.1 Handling of Payment-Related Personal Data

Personal data collected in connection with payment processing (excluding Sensitive Payment Data, which is handled exclusively by the Payment Aggregator under Clause 5.1) shall be handled by the Company in accordance with its Privacy and Cookie Policy and applicable data protection law, including the Information Technology Act, 2000 and rules made thereunder, and, upon coming into force and to the extent applicable, the Digital Personal Data Protection Act, 2023.

11.2 No Retention of Sensitive Payment Data

For the avoidance of doubt, and as stated in Clause 5.1, the Company does not retain Sensitive Payment Data on its own systems following transaction processing.


12. Limitation of Liability

12.1 To the maximum extent permitted under applicable law, the Company's aggregate liability arising out of or in connection with payment processing for any single order — whether in contract, tort, or otherwise — shall not exceed the total amount paid by the Customer for that order.

12.2 The Company shall not be liable for indirect, incidental, or consequential loss arising from a delayed, failed, or disputed payment transaction, including loss arising from currency fluctuation or third-party Payment Aggregator system unavailability.

12.3 Nothing in this Clause 12 shall operate to exclude or restrict any liability that cannot lawfully be excluded under the Consumer Protection Act, 2019, the Payment and Settlement Systems Act, 2007, or other mandatory applicable law.


13. Grievance Redressal

Grievances concerning payment processing, transaction disputes, or refunds may be directed to the Company's Grievance Officer, appointed in accordance with the Consumer Protection (E-Commerce) Rules, 2020:

The Grievance Officer shall acknowledge a grievance within forty-eight (48) hours and shall endeavor to resolve it within one (1) month of receipt, without prejudice to the Customer's right to approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, or, in respect of a payment-specific grievance, the grievance redressal mechanism of the relevant Payment Aggregator, bank, or card network.


14. Amendment and Severability

14.1 The Company reserves the right to amend this Policy at any time by posting a revised version on the Platform, together with an updated "Last Reviewed" date. Amendments shall take prospective effect and shall not apply to a transaction already completed prior to the date of posting.

14.2 If any provision of this Policy is held invalid, illegal, or unenforceable by a court or authority of competent jurisdiction, such provision shall be severed, and the remaining provisions shall continue in full force and effect.


15. Governing Law and Jurisdiction

15.1 This Policy shall be governed by the laws of India.

15.2 Subject to Clause 15.3, disputes arising under this Policy shall be subject to the exclusive jurisdiction of the competent courts at Pune, Maharashtra.

15.3 Nothing in Clause 15.2 shall restrict a Consumer's statutory right under Section 34(2) of the Consumer Protection Act, 2019 to institute proceedings before a Consumer Disputes Redressal Commission having jurisdiction over the Consumer's place of residence or business.
